§ 1. General Information
1.1. These Terms and Conditions ("Terms") apply to all purchases made on the ESME webshop, owned and operated by ESME, a Danish company.
1.2. By placing an order, the Customer accepts these Terms, which will apply unless otherwise agreed in writing.
1.3. All prices on the webshop are stated in Danish kroner (DKK) and include VAT unless otherwise stated.
§ 2. Ordering and Contract Formation
2.1. A purchase agreement is only considered binding once ESME has confirmed the Customer’s order by email.
2.2. ESME reserves the right to cancel or refuse an order in cases of obvious mispricing, technical errors, or if the product is unavailable.
§ 3. Products and Made-to-Order Items
3.1. Unless otherwise stated, all ESME jewelry pieces are made-to-order.
3.2. Production time for made-to-order products is typically 2–3 weeks. This timeframe is approximate and may vary.
3.3. Custom orders cannot be canceled, returned, or exchanged, cf. § 8.
§ 4. Prices and Payment
4.1. All prices are listed in Danish kroner (DKK).
4.2. Payment is processed securely through the available payment options listed on the webshop.
4.3. The Customer will be charged at the time the order is placed.
§ 5. Shipping and Delivery
5.1. ESME currently ships exclusively within Denmark.
5.2. Standard shipping time is 3–5 business days for ready-made items. For made-to-order pieces, delivery time includes the production period specified in § 3.
5.3. Shipping within Denmark is free of charge.
§ 6. Transfer of Risk
6.1. The risk of the goods passes to the Customer upon physical receipt of the shipment.
§ 7. Right of Withdrawal (Returns)
7.1. The Customer has a 30-day right of withdrawal from the day of receipt.
7.2. The right of withdrawal applies only if the product has not been used beyond what is necessary to determine its nature, characteristics, and function, comparable to trying on an item in a physical store.
7.3. The Customer is liable for any deterioration in value resulting from improper handling.
7.4. The right of withdrawal does not apply to custom-made products or personalized jewelry, cf. § 3.
§ 8. Exchanges
8.1. The Customer may exchange an item for a different size or finish.
8.2. If the Customer wishes to exchange for a different product, the Customer must return the original item (subject to the right of withdrawal) and place a new order.
8.3. Custom orders cannot be exchanged.
§ 9. Warranty
9.1. All products are covered by a 2-year warranty in accordance with the Danish Sale of Goods Act (Købeloven).
9.2. The warranty covers manufacturing and material defects but not damage caused by misuse, lack of care, accidents, or normal wear.
9.3. The Customer must notify ESME within a reasonable time after discovering a defect.
§ 10. Return Procedure
10.1. Return instructions will be provided upon request.
10.2. The Customer is responsible for ensuring that the product is securely packaged during return shipment.
10.3. Price for return is paid by the Customer and ESME is not responsible for the package until its received.
§ 11. Personal Data
11.1. ESME processes personal data in accordance with applicable data protection legislation.
11.2. For detailed information, please refer to ESME’s Privacy Policy.

§ 13. Complaints and Dispute Resolution
13.1. Customers are encouraged to contact ESME directly to resolve any complaints.
13.2. If a solution cannot be reached, the Customer may submit a complaint to:

13.3. For EU-based dispute resolution, Customers may use the EU Commission’s Online Dispute Resolution platform: https://ec.europa.eu/odr
§ 14. Amendments to Terms and Conditions
14.1. ESME reserves the right to amend these Terms at any time for legal, operational, or business-related reasons.
14.2. Amendments will not apply retroactively to orders already confirmed unless required by law.
14.3. The applicable Terms will always be available on the webshop.
